AIG freed from ‘too big to fail’ regulation

US regulators have freed AIG from the shackles of “too big to fail” regulation in a landmark moment that reverses an important part of President Barack Obama’s post-crisis crackdown on big finance.
The insurance company, which along with the likes of Lehman Brothers and Bear Stearns came to symbolise Wall Street recklessness when taxpayers bailed it out in 2008, will no longer be considered a threat to financial stability.
At a crunch meeting on Friday a council including the most powerful financial regulatory agencies in the US voted by a majority of six to three to rescind AIG’s status as a “systemically important” institution.
The decision makes the insurer arguably the biggest winner to date in the Trump administration’s drive to deregulate the US economy, liberating the group from proposed capital surcharges and other federal restrictions on its business.
Significantly, Janet Yellen, the Obama-appointed Fed chair, voted in favour of the de-designation — having overseen its supervision by the central bank regulator since she took charge in 2014.
Proponents of tougher regulation criticised the move. “It is an historic mistake and a slap in the face to the tens of millions of Americans who suffered and continue to suffer from the devastating 2008 financial crash,” said Dennis Kelleher, who runs the pressure group Better Markets.
The 10 members of the Financial Stability Oversight Council, the body that decides whether non-bank financial companies are “systemically important”, have been bitterly divided over the issue, said people familiar with the matter.
Trump appointees, led by Treasury secretary Steven Mnuchin, have been supportive of AIG’s case that it is a radically different business to the one that blew up in 2008.
AIG needed a $185bn taxpayer bailout after it was brought to its knees by financial products such as credit default swaps. It has since exited the businesses that turned toxic in the crisis and disposed of about half its $1tr in assets.
Several Obama-era appointees who remain in post at the top of some leading Washington agencies had fought against removing the designation.
Richard Cordray, director of the Consumer Financial Protection Bureau, Martin Gruenberg, chairman of the Federal Deposit Insurance Corporation and Melvin Watt, who runs the Federal Housing Finance Agency all voted against it.
